Terms of Service

These Terms of Service (‘Agreement’) apply to all sales between Lynne Dorrien Rugs, Suppliers (‘us/we/our’) and Customers (‘you/your’) in relation to all sales of product(s) and services and subject to Spanish Law and the jurisdiction of EU courts.

We reserve the right to vary the Terms from time to time and without notice. Furthermore, changes will become effective immediately upon posting on the site. By continuing to use the site you agree to accept any such variation.

If any provision of these Terms of Service is held by any competent authority to be invalid or unenforceable, in whole or part, the validity of the other provisions of these Terms of Service and the remainder of the provision in question shall not be affected thereby.

Intellectual Property Rights

We are the sole distributor of Lynne Dorrien Rugs. All designs are protected by copyright. Designs must not be copied, downloaded or plagiarised in any way. Nothing in these terms of business grants a sub-licence to use designs registered to Lynne Dorrien Rugs. Using any design without the registered holder’s explicit consent will be considered actionable.

We supply products for residential and contract use. If you are a business, we supply products for internal business purposes only. Products are not for resale unless otherwise agreed in writing.

Placing an Order

By placing an order you are making an offer to Lynne Dorrien Rugs to purchase product(s) as detailed and described. It is your sole responsibility to ensure that the colours, sizing and materials are suitable for their intended purpose. We will not be responsible should any measurements or colours you provide subsequently turn out to be incorrect. We reserve the right to cancel an order in the event of Force Majeure; should prices be incorrectly quoted due to typographical error; we are unable to deliver to address given.

Custom Orders

Custom orders which do not involve changes to existing artwork will not incur a surcharge.
Artwork required for the following, but not limited to: shape, sizes and/or colour changes, will incur a surcharge of €150. This will be invoiced and payable before any alterations are submitted for approval. An order will not be confirmed until all aspects of the project have been agreed to by all parties concerned.

Bespoke Orders

Bespoke design fee is €400 which will be invoiced and payable before any design material is submitted for approval. An order will not be confirmed until all aspects of the project have been agreed to by all parties concerned.

Product Size

As all of our rugs are made entirely by hand, please note that sizes may differ slightly to those specified. Please allow for an acceptable tolerance of approximately +/- 10cm (length and/or width) when measuring for your rug.

Product Colour

Colour reproductions of all products on this website are a close representation. We do not accept responsibility for variation in colour caused by browser software or computer system. Yarn samples are the best way to see an indication of the colours of your chosen design.

When viewing yarn samples please note the following:

  • the cut ends of the yarn represent the colour of a hand-tufted or hand-knotted rug.
  • the length of the yarn represents the colour of a hand-woven rug

Due to the handcrafted nature of our products, the actual colour and surface texture may differ slightly from a sample. As with all raw materials and natural fibres, minor differences are inevitable.

Please be aware that changes in shade will occur as the rug catches light at different angles. The pile may also appear to change colour or appear patchy with any change in direction through use. This is normal and should not be considered as a defect. Please be aware that colours may also fade over time if left exposed to direct sunlight.

Order Confirmation

You will receive an order confirmation by email and then in writing, as soon as you have placed an order. Please retain this as you may need to refer to it in any correspondence.  If you do not receive confirmation, please contact us to confirm that your order has been placed successfully. 

Prices

Appropriate design fees are to be paid in full before the project commences.
Upon agreement of all aspects of the project a 50% deposit is required, before the manufacturing process commences. Once manufacturing has been completed the rug is ready for shipping. At this point a photo will be sent along with a request for the balance to be paid.

All prices are in Euros. Any charges related to a change in currency will be paid for by the customer. Lynne Dorrien Rugs is not deemed accountable for any fluctuations in exchange rates.

Additional charges for customs or import duties levied once the package reaches its destination will be the customer’s sole responsibility.

Payment

Many of us worry about submitting personal details on the Internet or by phone, especially with their credit/debit card numbers. In order to avoid any concerns regarding privacy, security and/or fraud, we only accept payments made by Bank Transfer.

We retain ownership of any product ordered until we have received payment in full.
No product may be collected or delivered before payments have been cleared through the banks.

If payment is not made, within the period of time outlined in the terms here, we reserve the right to:

  1. Suspend our obligations under the order
  2. Terminate the order and any other agreement for the provision of product(s). In such an event, it is agreed that our damages are no less than the amount of the deposit. The deposit will be retained together with our right to claim against you for breach of these conditions.

Lead Time

After all the details of the project have been agreed then manufacturing will commence. The lead time for Lynne Dorrien Rugs refers to the manufacturing process. This involves, but is not limited to, purchase of yarn, dying colours, manufacturing and detailing.

An average lead time is 8 – 12 weeks

Lead time is naturally dependent on factors such as the number of special colours required, scale and complexity of design. All lead times are estimates and may be subject to change from time to time. Should any changes arise you will be notified immediately. We accept no liability (whether direct or indirect) if completion takes place at any time other than the estimated date.

Delivery Times & Charges

We ship to most national and international destinations.

Products will be shipped to you within 7 working days of the payment clearing. We use a reputable company with full tracking service. You have the right to select a company of your choice should you wish. In this event you will take full responsibility for the safe delivery of the product(s).

All deliveries are charged by volumetric weight. An estimate for this cost will be provided with the order quotation. We reserve the right to amend this if affected by rising fuel costs or changes with transportation.

Lynne Dorrien Rugs will not be liable should deliveries be affected by Force Majeure or any circumstances outside our reasonable control. We are not responsible for direct or indirect loss of profits or other financial loss or damages suffered by you as a result of delay or re-scheduling. Clients will of course be advised of any changes which may affect delivery times.

Products will be delivered to the address provided when the order was confirmed. If there is any change in delivery details, please advise us as soon as possible. Once products have been dispatched changes cannot be made. The courier company will request a signature so please be sure to have someone present at the allotted delivery time.

Transportation will be arranged with a reputable carrier. We are not deemed responsible for any damage or delay caused by the carrier.

Changes & Cancellation

Once an order for a custom or bespoke product is accepted you will not be entitled to make any changes. Notwithstanding, we will endeavour to incorporate any alterations, but this is not guaranteed. Should changes be requested please be advised that production will cease. Changes will not take place until any possible amendments in costing and completion date have been confirmed and agreed.

Requests for cancellation will of course be considered. Acceptance will depend on when the request is presented during the manufacturing timeline. If a request for cancellation should be approved, please be aware that any expenses incurred for materials purchased and any hours worked in production will be billable.

After sales

Please contact us for any help or advice after you have made you purchase.
We take pride that our product(s) will be free from defects in design, materials and workmanship. Slight variations are to be considered acceptable due to the handcrafted nature of the product(s) and should not be interpreted as defects. In the event you feel there is any fault then please contact us directly to discuss the problem


RETURNS POLICY

Returns are not possible on any custom or bespoke product(s) ordered as these are specially commissioned and tailor-made to your specifications. This means that we are unable to offer refunds, replacements or credit if you are not satisfied with your choices.

Please note we are not liable for any fault arising from wear and tear, damage, misuse or alteration to the product(s).

Notwithstanding, your statutory rights are not affected if you believe that a product is faulty, or not as described. Should there be a fault with the product then please contact us as soon as possible. Send details stating the order number and advising us of the problem. Please do not return the product to the studio address as shown on this page without prior confirmation as we will be entitled to refuse acceptance of the delivery.

Any product(s) returned to us, must be returned in the original condition – unused and undamaged, within 21 days of delivery. Product(s) must be re-packaged carefully to ensure complete protection during transport. The safe return and any related costs are the responsibility of the client. If your complaint is justified and you comply with your legal obligations, we will refund the price of the product together with standard delivery costs. Please note that expedited delivery with an elevated cost will not be covered under these terms. If we do not receive the product in the same condition as it left our studio, we have the right to reduce the refund in consideration for its loss in value. Our total liability shall in no circumstances exceed the price of the product.

Damage in transit.

Please check all deliveries carefully. Should the product(s) arrive visibly damaged, you can refuse acceptance. Indicate your reasons for doing so directly and clearly on the delivery note. If you do not have a delivery note, please use the receipt attached to the package. Please take photos of the packaging and any external signs of damage. Contact us and forward photographic evidence immediately.
We will then proceed with a claim against the transport company. A credit will be issued once the claim has been resolved with the freight carrier.

Should you personally decide to organise shipping please note that Lynne Dorrien Rugs carries no responsibility for damage, delays or other subsequent problems that may arise.


Personal Data

According to the current legislation relating to the Protection of Personal Data we inform you that your personal details such as name, email address and contact number will be incorporated into a data file under the responsibility of Lynne Dorrien Rugs. This data is collected for the sole purpose of being able to maintain contact, respond and deal with the provision of services contracted by the client or interested party.

Lynne Dorrien Rugs ensures clients that all personal information will be treated confidentially and the current legislation for the protection of data is complied with at all times. Whilst we take all possible measures to avoid the loss, abuse, alteration, unauthorised access and theft of personal information we can not be held responsible for flaws in technology or any risks arising from this.

Should we wish to use any photographs for the purpose of marketing or publicity, we will inform you and ask for your full consent before doing so.

Please be assured that we do not sell, rent or exchange your personal information with any third party. However, personal information will be made available if required to do so by a court order, by applicable legislation or if you violate our Terms of Service.
